Who is eligible?
Both the owner and the renter must be residents of the Town.

How many apartments is the Town permitting?
The number of apartments to be permitted at this time shall be no more than 20 in each of the 5 school districts located within the Town of East Hampton.

Are there any prohibitions about where I can put an apartment?
An affordable accessory apartment shall not be permitted on a lot on which there exists an artist studio, rooming house or borders, home occupation, home professional office, pre-existing accessory apartment, two-family detached dwelling or multiple-family dwelling. The owner of a single-family residence with an affordable accessory apartment may not also rent guest rooms.

Can the apartment be in a detached structure?
No, the apartment must be part of the main structure. It cannot be in an out building.

How big does my lot have to be?
No affordable accessory apartment shall be constructed on a lot with a total lot area less than 15,000 square feet.

How big can the apartment be?
The affordable accessory apartment shall be a minimum of 300 square feet and shall not exceed 600 square feet. The affordable accessory apartment shall not contain more than one conventional bedroom.

How do I apply for a permit?
The owner of a single-family detached dwelling may apply to the Building Department for a permit to construct an affordable accessory apartment.
8.
How much does a permit cost?
The fee for the initial permit application for an affordable accessory apartment permit shall be $50, unless such application is made to legalize an otherwise illegal apartment, in which case the fee shall be $500.
9.
Who can rent the apartment?
The affordable accessory apartment will be used only for the year-round occupancy of an East Hampton Town resident No more than 2 persons are permitted to reside in the apartment. You as landlord are free to rent to anybody you want so long as they meet the above criteria.
10.
How long does the lease have to be for?
A minimum term is one year.
